At the Burnaby Deer Lake Law Group, we encourage families to first consider a non-adversarial alternative to resolving the issues that arise as a result of the breakdown of the relationship.  By working with a Family Mediator, couples can address all the same issues as through litigation, but with less stress and fewer damaging effects on the entire family.

By working with an impartial, knowledgeable Family Mediator, spouse have the opportunity to reach a mutually acceptable agreement and achieve a "win – win" result for both parties.

Through mediation, couples retain control of the process, including costs and time dedicated to the resolution of the issues.

The Mediator will guide the settlement negotiation, and ensure that the decisions made as part of the mediation process are informed, voluntary, and fair to each spouse.

In certain situations, the Family Mediator will advise the parties to seek independent legal counsel in order to better understand how their intended decisions may affect them or their family in the future.

A Win-Win Way

Traditional family mediation emphasizes the importance of understanding what problems led to the break up, the emotional undercurrents that may create obstacles to achieving resolution, and how self-interest guides the choices made during the mediation process.

We believe that the divorce negotiation process should remain future-focused and should aim to settle issues of spousal support, child support and custody, and asset division based on financial disclosure and information about legal rights and obligations -- in a timely manner.

Although we require both spouses to attend the No Cost Pre-Mediation together, the parties may choose to attend all or some subsequent divorce negotiation meetings separately or together. The Family Mediator is further able to work effectively towards a timely consensus using email correspondence, telephone conference, and Skype.

Confidentiality

Unlike litigation where Affidavits are filed in court and become a matter of public record, all information revealed during the family mediation process remains confidential and is inadmissible as evidence in any legal proceeding.
